Thank you for choosing PlanIt android app and services (collectively, "Services"). The Services are provided by Haim Shoham ("Author"). PlanIt Android app will be referred to as “PlanIt”, "app", or "the app" in this document. By using the Services, you are agreeing to these Terms of Service (“Terms”) now and as amended by the Author. Please read the Terms carefully. If you are using the Services on behalf of an organization or entity (“Organization”), then you are agreeing to these Terms on behalf of the entire Organization. In that case, “you” and “your” may refer to the Organization. If you don't agree to the Terms, do not use the Services.
PlanIt allows you to create and store content on your device, including but not limited to information and text. You retain ownership of any intellectual property rights that you hold in that Content.
The privacy policy explains how your personal data is treated and how your privacy is protected when using the Services. By using the Services, you agree that the Author can use such data in accordance with the privacy policy.
The Author may release updates to the PlanIt app software once a new version or features become available, and this software may update automatically on your device. The Author may add or remove functionalities or features in the normal course of improving, changing, and/or updating the PlanIt app. The Author may also suspend or stop the Services altogether at the Author's sole discretion any time and for any reason. You can choose to stop using the Services any time. The Author may also stop providing the Services to you or add or create new limits to the Services at any time.
The Author gives you a personal, worldwide, royalty-free, non-assignable and non-exclusive license to install and use PlantIt app software provided to you as part of the Services. You may not copy, modify, distribute, sell, or lease any part of the app or its included software, nor may you reverse engineer or attempt to extract the source code of the software, unless local laws prohibit those restrictions.
You may use the Services only as permitted by law. The Author may suspend or stop providing the Services to you if you do not comply with the Terms. Using the Services does not give you ownership of any intellectual property rights in the Services. The Terms do not grant you the right to use any branding or logos used in the Service.
The Author does not make any specific promises about the Services. For example, the Author does not make any commitments about the content within the Services, the specific functions of the Services, or their reliability, availability or ability to meet your needs. The Author expressly disclaims any warranty for the Services. The Services are provided “as is” without warranty of any kind, either express or implied, including but not limited to, the implied warranties or merchantability, fitness for a particular purpose, or non-infringement.
To the maximum extent permitted by law, the Services are provided on an "as is" basis. You expressly understand and agree that: In no event shall the Author be liable for lost profits, revenues, or data, financial losses or direct, indirect, incidental, special, consequential, exemplary or punitive damages. You are solely responsible for any damage to your computer equipment or devices, including but not limited to, laptop computers, desktop computer, tablets, smartphones, smartwatches. The entire risk arising out of use or performance of the Services remains with you.
From time to time the Author may modify existing terms and/or update the Terms with additional terms for any reason, in which case the Author will post the term changes to the website. When changes to the Terms are made, the "Last Updated" date at the beginning of this Terms of Service document will be changed. Any changes made to the Terms are effective as of this Last Updated date and replace any prior terms. You are advised to consult this Terms of Service document regularly for any changes, as continued use is deemed approval of all changes.
